PeppyStep Assumption of Risk and Liability Waiver

Important notice

THIS AGREEMENT DESCRIBES RISKS OF DOG WALKING, PET CARE, ACTIVITY PLANS, AUTOMATED AND INFORMATIONAL CONTENT, AND CARE REMINDERS. FOR ADULT USERS IN U.S. JURISDICTIONS WHERE SUCH A RELEASE IS LAWFUL, SECTION 8 ALSO RELEASES CERTAIN CLAIMS BASED ON PEPPYSTEP'S ORDINARY NEGLIGENCE. IT DOES NOT RELEASE CLAIMS OR RIGHTS THAT APPLICABLE LAW DOES NOT ALLOW YOU TO WAIVE.

Please read this before accepting. This agreement is part of the PeppyStep Terms of Service ("Terms").

1. The Service

PeppyStep LLC ("PeppyStep," "we," "us") provides software for activity tracking, walking plans and guides, pet-care organization, nutrition and environmental information, reminders and logs, and any automated or AI assisted features we may offer (the "Service"). PeppyStep is not a dog walker, pet sitter, trainer, veterinarian, emergency service, weather service, or provider of in-person pet care. Unless PeppyStep expressly states otherwise, people whom users invite through the Service are not PeppyStep employees or agents, and PeppyStep does not select, employ, supervise, vet, or guarantee them.

2. Your eligibility and authority

If you accept this agreement for yourself, you represent that: (1) you are at least 18 years old or the age of legal majority where you live; (2) you have legal capacity to enter this agreement; and (3) you own, keep, or have the owner's permission to add each dog you manage and to share that dog's information with people you invite. Each adult family member, walker, sitter, or caretaker must use their own authorized access and accept the Terms and this agreement for themselves. You cannot release another person's claims merely by allowing that person to use your account.

3. Risks of walking and caring for dogs

Dog walking and pet care involve risks, including: a dog escaping, becoming lost, becoming ill, being injured, or dying; bites, scratches, falls, pulling injuries, collisions, and attacks involving people or animals; traffic, unsafe routes, poor lighting, crime, weather, heat, cold, smoke, terrain, obstacles, and environmental hazards; property damage; physical exertion that may be unsuitable for a particular person or dog; and acts or omissions of owners, walkers, sitters, family members, bystanders, drivers, and other third parties. Some of these risks are inherent and cannot be completely eliminated.

4. Limits of plans, tracking, and informational content

Activity measurements, location data, routes, goals, environmental information, nutrition content, plans, and automated outputs may be delayed, incomplete, inaccurate, unavailable, or unsuitable for a particular person or dog.

THE SERVICE DOES NOT PROVIDE VETERINARY OR HUMAN MEDICAL ADVICE, DIAGNOSIS, PROGNOSIS, TREATMENT, PRESCRIBING, EMERGENCY TRIAGE, OR POISON-CONTROL SERVICES. AUTOMATED OUTPUTS MAY CONTAIN ERRORS OR OMIT IMPORTANT FACTS. DO NOT USE THE SERVICE TO DETERMINE MEDICATION DOSE, CONCENTRATION, ROUTE, OR TREATMENT.

You must independently evaluate conditions and guidance and consult a qualified veterinarian or healthcare professional when appropriate. In an emergency, contact an appropriate veterinarian, emergency service, or animal poison-control service; do not wait for a notification from PeppyStep.

5. Medication, feeding, appointment, and care tools

REMINDERS, NOTIFICATIONS, SCHEDULES, AND LOGS ARE ORGANIZATIONAL AIDS ONLY. THEY MAY BE DELAYED, DUPLICATED, LOST, INACCURATE, OR NOT DELIVERED because of device settings, connectivity, operating-system restrictions, user input, synchronization issues, or service failure. You are responsible for independently verifying: the correct animal; medication name, concentration, dose, route, and time; whether a dose or feeding was actually given; whether another caretaker already completed the task; and appointment details. Do not use PeppyStep as your only reminder, medication-administration record, or emergency record.

6. Your responsibilities

You are responsible for choosing whether, when, where, and how to walk or care for a dog, considering the dog's known age, health, behavior, breed characteristics, fitness, medications, and conditions. You represent that, to your knowledge, each dog you choose to include in an activity is healthy and fit to participate in that activity, and that you will consult a veterinarian when you are unsure. You agree to disclose known aggression, bite history, material health limitations, and legally required restrictions to any person you authorize to care for the dog, and to comply with applicable leash, licensing, vaccination, animal-control, and safety laws. Responsibility for injury or damage caused by a dog will be determined under applicable law. Nothing in this agreement makes you responsible for another person's conduct when applicable law would not otherwise do so.

7. People you invite

You are responsible for selecting the people you invite, choosing their permissions, giving accurate instructions, and promptly revoking access when it is no longer appropriate. PeppyStep remains responsible for its own operation of the Service, including its authentication, authorization, privacy, and security obligations, subject to the Terms and applicable law.

8. Assumption of risk and limited release for adult U.S. users

YOU KNOWINGLY AND VOLUNTARILY ACCEPT THE INHERENT AND ORDINARY RISKS DESCRIBED IN SECTIONS 3 THROUGH 7 THAT ARISE FROM YOUR OWN WALKING OR PET-CARE ACTIVITIES AND FROM YOUR DECISION TO USE OR RELY ON INFORMATIONAL FEATURES OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY THE LAW THAT APPLIES TO YOU, AND ONLY WITH RESPECT TO CLAIMS YOU LEGALLY OWN, YOU RELEASE PEPPYSTEP LLC AND ITS OFFICERS, DIRECTORS, AND EMPLOYEES (THE "RELEASED PARTIES") FROM CLAIMS FOR BODILY INJURY, INJURY TO OR DEATH OF A DOG, OR PROPERTY DAMAGE ARISING FROM THOSE DESCRIBED RISKS, INCLUDING CLAIMS CAUSED BY THEIR ORDINARY NEGLIGENCE.

This release does not apply to: gross negligence, recklessness, or willful misconduct; fraud or fraudulent concealment; liability for death or personal injury that applicable law prohibits releasing; violation of a statute or regulation where liability cannot lawfully be waived; product-liability or consumer-protection rights that cannot be waived; PeppyStep's independent privacy, data-security, payment, or contractual obligations outside the risks specifically described above; claims owned by a minor or another person; or conduct occurring before you accepted this agreement. This section is not intended to expand any assumption-of-risk defense beyond what applicable law recognizes.

9. Limited responsibility for third-party claims

To the maximum extent permitted by law, you will reimburse the Released Parties for reasonable, documented losses arising from a third-party claim only to the extent those losses are finally determined by a court, or agreed in a settlement you approve, to have resulted from: (1) your unlawful or intentionally wrongful conduct; (2) your material breach of Sections 2 or 6; or (3) injury or damage for which applicable law makes you legally responsible as an owner, keeper, or person controlling a dog. This obligation does not apply to the extent a claim results from PeppyStep's negligence, breach of contract, violation of law, gross negligence, recklessness, willful misconduct, or fraud. PeppyStep must give you prompt notice of a claim when reasonably practicable. You may participate in the defense with counsel at your own expense. Neither party may settle in a way that admits fault by or imposes a non-monetary obligation on the other without that party's written consent, not unreasonably withheld. This section does not require a parent or guardian to indemnify PeppyStep against a minor's personal-injury claim where doing so would be prohibited or contrary to public policy.

10. Teen profiles and parental consent

A minor may not independently accept this agreement or create a binding release of claims. Before a teen profile is activated, PeppyStep must obtain consent from the teen's authenticated parent or legal guardian, who must: (1) confirm identity and authority; (2) authorize the teen's participation; (3) review the safety disclosures in the notice shown when you create a teen profile; (4) acknowledge the inherent risks; and (5) accept the Terms and this agreement in their own capacity. Neither the teen's acknowledgment nor the parent's consent waives any claim belonging to the teen when applicable law does not permit that claim to be waived. The Service is not available to children under 13.

11. Mandatory rights

PeppyStep is offered in the United States only (see Terms Section 20). Regardless of where you live, Sections 3 through 7 remain factual safety acknowledgments, and Section 8 applies only to the extent permitted by the law that applies to you. Nothing in this agreement excludes or limits liability for death or personal injury caused by negligence where such a limit is prohibited, and nothing limits consumer, product-liability, privacy, or data-protection rights that cannot lawfully be waived.

12. Relationship to the Terms

This agreement is incorporated into the Terms. The Terms contain any applicable dispute-resolution, arbitration, jury-trial waiver, class-action waiver, governing-law, venue, and limitation-of-liability provisions. Any choice-of-law or forum provision is subject to mandatory consumer protections that apply where you live; if a conflict exists, the more specific protection in this agreement controls for personal injury, pet injury, and the risks described here.

13. Severability

If a provision is unenforceable, it will be severed or narrowed only to the extent applicable law permits, and the remainder continues in effect. A court must not rewrite a provision in a way that would deprive a consumer of a non-waivable right. Sections 8 and 9 apply only to events occurring while the accepted version was in effect.

14. Changes

PeppyStep may change this agreement prospectively and will provide reasonable notice of material changes. A change that materially expands an assumption of risk, release, indemnity, arbitration obligation, or provision affecting minors will not apply until the affected adult user or guardian affirmatively accepts the revised agreement.

15. Electronic acknowledgment

By checking the acceptance box that names this agreement at signup, you confirm you have read and understood it, accept the risks, and agree to it; you consent to accept it electronically and to retain a copy.
